Terms of Service

By creating an account and using Memorai you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the service.

1. The Service

Memorai provides AI-assisted photo restoration, enhancement, colorization, and archiving tools. The service is provided on an "as is" basis. We reserve the right to modify, suspend, or discontinue features with reasonable notice.

2. Your Account

• You must be at least 16 years old to create an account.
• You are responsible for maintaining the security of your password.
• You may not share your account or allow others to access it.
• You must provide accurate account information.

3. Acceptable Use

You agree not to:

• Upload photos you do not own or do not have permission to process.
• Upload illegal content, including CSAM, content depicting non-consensual acts, or defamatory material.
• Attempt to reverse-engineer, scrape, or abuse the service infrastructure.
• Use the service for commercial resale without a written agreement from us.
• Circumvent storage limits or abuse free-tier access through multiple accounts.

4. Your Content

You retain full ownership of all photographs you upload. By uploading, you grant us a limited, non-exclusive license to process your photos solely for the purpose of providing you with the service. We do not claim ownership over your photographs and we do not use them for AI training without explicit separate consent.

5. Storage & Quotas

• Free accounts receive 10 MB of total storage.
• Paid plans receive the storage stated at the time of purchase.
• If you exceed your storage quota, new uploads will be rejected until space is freed.
• We may delete files from inactive free accounts after 12 months of inactivity with 30 days notice.

6. Payments & Subscriptions

• Paid plans are billed monthly or annually as selected.
• You may cancel at any time. Cancellation takes effect at the end of the billing period.
• We do not offer refunds for partial billing periods unless required by law.
• We may change pricing with 30 days notice to current subscribers.

7. Disclaimer of Warranties

The service is provided without warranty of any kind. We do not guarantee that AI results will meet your expectations, that the service will be uninterrupted, or that restorations will be accurate or complete. AI outputs are probabilistic and imperfect.

8. Limitation of Liability

To the fullest extent permitted by law, Memorai shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including loss of data or photos.

9. Termination

We may terminate or suspend your account if you violate these Terms. You may delete your account at any time from your account settings. Upon termination, your photos will be deleted per our retention policy.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law provisions.

11. Changes to Terms

We will notify you by email of material changes at least 14 days before they take effect. Continued use constitutes acceptance.
